    This is a TRADE AUCTION only. No bids should be made by any bidder in their capacity as a consumer.

    VIEWING
    Prospective Purchasers may undertake viewing of the lots, strictly by appointment with the Vendor. COVID precautions and social distancing rules apply along with hand sanitisation and wearing of face masks.

    DESCRIPTIONS
    Please note the following:
    - The description of the various Lots is believed to be correct. For the guidance of the Purchasers, approximate weights or measures of each Lot are given in this Catalogue, but it must be emphasised that this is given for guidance only. No warranty as to weight, quality or condition can be given and any intending Purchaser shall be deemed to have inspected the Lot in which he is interested. The Auctioneers will supply information on any particular Lot as far as they can as to quality, quantity and position, but no warranty can be given. Any information regarding any lot has been given by the Vendor.
    - Directions on how to get to each Vendor’s holding have been given at the commencement of each Lot.
    - All Lots will be sold for the quantity on offer and as inspected, not by the bale.
    - Options will not be given. Bidders are requested to bid on each lot they wish to purchase.

    RESERVE PRICES AND PROVISIONAL SALES
    All Lots are put up for sale, subject to any reserve price imposed by the Vendor. Some lots may have reserve prices and the final highest bid on a lot may be subject to acceptance by the seller, if the reserve is higher. The highest final bidder on a lot is contractually obliged to stand by that bid, if it is accepted by the seller.

    REGISTRATION DEPOSIT
    Please note the following:
    - A Deposit of £500 will need to be paid to participate in the Timed Online Auction. Please note that all deposits are to be paid via Sagepay. No deposits will be taken over the phone. This is a “reserved payment” system whereby your money will only be taken when you have successfully purchased or become the highest bidder on a lot and goes towards the total purchase price. The purchaser will then be responsible to pay the remaining amount due.
    - Upon failure of compliance with the Conditions, money deposited in payment will be forfeited and the Lots which may remain uncleared after the time aforesaid will be sold by public or private sale, without notice to the former Purchaser and the deficiency (if any) by such second sale, together with all charges attending the same, shall be made good by the defaulter at this sale.
    - Unsuccessful purchasers should note that refunds of deposits can take approximately 3 - 5 days and you will get an email at the time we have processed the release from our side.

    TIPS ON BIDDING
    Register early and don’t bid late! And please note the following:
    - Bids cannot be withdrawn at any time. All bids are contractually binding. The highest bidder to be the Purchaser and no bidding shall be retracted after the hammer has fallen. The Auctioneers reserve the right to refuse any bidding and in the event of any dispute the Lot may be up again at the Auctioneers’ discretion.
    - If your bid has the value up to or at the reserve, the bid will be taken at it's maximum to the reserve.
    - If the lot has no reserve or if your bid is forced above the reserve by other bidders, then our increment system comes into play and you will see what the next minimum bid can be on the bid page. If your maximum bid is above the increment, the bid will go to the increment, unless someone thereafter forces the bid up to your maximum. Bidders cannot place a bid with the same maximum that someone else has already placed, so a warning will tell you if your bid is the same. You may pay less than your maximum bid if you win, therefore, depending on other bidders.

    COMMISSION BIDS
    Please note the following:
    - Commission Bids - We will accept commission bids on all lots up until 5pm on Wednesday 19th January 2022 and only when the suitable deposit has been lodged.
    - Please download & complete a Commission Bidding Form HERE and email to [email protected] or return to Brightwells Ltd, The Mews, King Street, Hereford, HR4 9BX if you wish to leave a commission bid.
    - Commission Bids will need to be accompanied by a deposit.

    RIGHTS & RESPONSIBILITIES
    Please note the following:
    - The Auctioneers intend to sell in the order lotted and as described in the Catalogue, but must reserve the right to make any alterations if so requested by a Vendor.
    - The Auctioneers will not be responsible for any Lots damaged by fire, accident or otherwise and all Lots are the Purchaser’s responsibility from the fall of the hammer.

    PAYMENT
    All Lots are sold for BACS transfer and must be paid for within 24 hours of the Timed Online Auction ending.

    REMOVAL OF LOTS
    All Lots must be removed as stated in the Catalogue and if not so removed, the Purchaser shall pay the Vendor a penalty of £20 per week for each week or part week until final clearance or forfeit the balance of the Lot at the Vendor’s discretion. The Purchaser shall indemnify the Vendor for any damage that may be caused to gates, fences etc. in the course of the removal of any Lot.

    NON-SALES
    In the event of a non-sale, any future negotiations to be through the Auctioneers, as Agents of the Vendor, when these Conditions will apply, subject to any written arrangements to the contrary.

    SALE PROCEEDS
    Clients’ monies paid to us will be held in Brightwells Limited Clients’ Auction Sales Account at Barclays Bank plc. Hereford Branch. Clients will not be entitled to any interest on balances in this account.

    HEALTH & SAFETY
    Please note the following:
    Purchasers are required to adhere to any Covid 19 rules, abiding by the regulations issued by the Government, when viewing and collecting, complying to all signage and instructions.
    - If you are experiencing any cough, fever or other respiratory symptoms or believe that you may have been exposed to COVID-19 or any other respiratory illness, please stay at home and do not view. Should Government guidance change these updates will be made available prior to the sale.
